Can a Chapter 7 discharge be revoked?
A judge may decide to revoke a discharge in a bankruptcy case under certain circumstances, generally involving allegations of fraud. For example, the court may revoke a discharge in a Chapter 7 case if a creditor is able to prove that the debtor was set to receive substantial property that would have been part of the bankruptcy assets but did not disclose that to the court. A discharge may also be revoked if a debtor refuses or is unable to explain misstatements uncovered in an audit of the case or if he or she refuses to provide documents requested as part of the audit.
