Will Bankruptcy Discharge All Debts – Richmond County GA Lawyer

Bankruptcy will not discharge all debts. You will have to pay off certain debts even after you get a bankruptcy discharge. Tax is one such debt. When you file a bankruptcy petition in a bankruptcy court, your creditors cannot seek to recover the debts from you. The must cease all collection efforts initiated by them.

As per law, the filing of a bankruptcy petition automatically stays any United States Tax Court proceeding to determine your tax liability until one of the event removing it occurs. The Bankruptcy court will lift the stay upon your request, the request of the IRS, or the request of any other interested party. The stay does not apply to (a) an audit to determine tax liability, (b) a demand for tax returns, (c) the issuance of a notice of deficiency to the debtor, or (d) he making of an assessment for any tax and the sending of a notice and demand for payment of the tax assessed for bankruptcy cases filed after October 22, 1994. During the stay, the Bankruptcy Court is the sole authority to determine whether the tax issue is decided in the bankruptcy court itself or in the Tax Court.
